Details:
The Plaintiffs argue that Congress lacks authority to mandate health insurance under the Commerce Clause. Furthermore, this case argues that the health care reform act violates the First Amendment right to free exercise of religion.
Status: This Complaint was filed the same day the Patient Protection and Affordable Care Act was passed. A hearing for the Motion for Preliminary Injunction was held on July 21. On October 7, Judge George Steeh ruled against the Motion for Preliminary Injunction, and dismissed the first two of the Plaintiff’s six claims enumerated in the Complaint. The Plaintiffs filed for appeal on October 22.
On June 1, this case went before the Sixth Circuit Court of Appeals for oral arguments. The three judge panel issued their ruling on June 29 that the individual mandate was a Constitutional exercise of federal government power. This was the first appellate court to rule on ObamaCare.
