In this case, the Plaintiffs challenge Patient Protection and Affordable Care Act because it arbitrarily discriminates against physician-owned hospitals and favors the operation of hospitals owned by individuals who are not physicians. The Plaintiffs argue that PPACA violates the Fifth Amendment’s Due Process Clause by furthering a private, non-public purpose, as well as the Equal Protection Clause, stating that the Federal government has no rational basis for choosing the business class to run hospitals.
Status: This case is now on appeal at the Fifth Circuit Court of Appeals.
