Mead v. Holder

District:

District of Columbia

Plaintiffs:

Five Individuals

Defendants:

Eric Holder, as United States Attorney General, U.S. Department of Health and Human Services, Kathleen Sebelius as Secretary of the HHS, U.S. Department of Treasury, and Timothy Geithner as Secretary of Treasury

Judge:

Gladys Kessler

Case number:

1:10-cv-00950

Details:

The Plaintiffs consider the purchase of health insurance to be contrary to their religious beliefs and claim that their rights are violated under the Religious Freedom Restoration Act of 1993.

Status: The parties await the Court's decision for the Plaintiff's request for oral argument on the Motion to Dismiss. The Plaintiffs believe if the Motion to Dismiss is denied by the Court, their claims can be resolved through Summary Judgment, as noted in the two parties' Meet and Confer Statement, filed on October 7. Concurrently, the Defendants believe if their Motion to Dismiss is denied, they can retain the rights to discovery over the Plaintiffs' claims that the PPACA violates the Religious Freedom Restoration Act.

Update February 22, 2011: Judge Gladys Kessler ruled with the Defendants and dismissed the case.
