The Complaint states that the Patient Protection and Affordable Care Act violates the rights to medical autonomy and privacy guaranteed by the Fourth, Fifth, and Ninth Amendments, the First Amendment rights of legislators who will soon be burdened with the law-making of the Independent Payment Advisory Board, which will oversee changes to Medicare, exceeds the commerce-regulation, taxing, and spending powers of Congress, and erodes the Separation of Powers by establishment of the IPAB. Furthermore, the Plaintiffs argue that the PPACA violates the implied powers granted by the Necessary and Proper Clause and the Tenth Amendment by undermining state sovereignty.
